SUPERIOR Court Judge Kenneth L. Govendo sentenced Jerry H. Smith to serve 275 days in prison for his sixth conviction of driving under the influence of alcohol.
On Jan. 13, Judge Govendo found Smith guilty of DUI, refusing to submit to a breath test, and violating the terms of his probation in a previous DUI case, TR-21-01174.
Smith, a citizen of the Federated States of Micronesia, will serve the remaining 275 days in that case. The sentence will run concurrently with another DUI case, TR-25-00275, in which he was ordered to serve 30 days. The court dismissed a third case, TR-22-03958.
Smith must report to the Department of Corrections on Feb. 24 at 8 a.m. He is scheduled for release on Nov. 26 at 8 a.m.
The court also ordered Smith to pay a $1,000 fine. His driver’s license was revoked for one year and must be surrendered to the Adult Probation Office.
After completing his prison term, Smith will be placed on two years of probation and must perform 100 hours of community service. He is also required to pay a $265 probation fee and court costs.
