Magofna gets 13 days for assaulting partner

Magofna admitted assaulting his partner by slamming her head on the picnic table several times last month.

The court dismissed with prejudice the charges of disturbing the peace and possession of marijuana as moved by the prosecution.

Govendo originally sentenced Magofna to one year imprisonment, but all suspended.

Should Magofna violate the terms of his probation by committing another crime of domestic violence, the remaining months of this suspended sentence will be re-imposed.

Magofna will attend and complete anger management counseling, a parenting class, and other counseling recommended by a treatment provider or the Adult Probation Office.

He will  submit to an alcohol and drug assessment and treatment, if recommended, and random drug screens.

Magofna will not purchase, possess, or consume alcohol or any illegal drugs for the entire term of his probation.

He will not have any contact with his victim and will complete 100 hours of community work service, pay a $200 fine, other court costs and probation fees.

Assistant Attorney General Peter Prestley prosecuted the case while Assistant Public Defender Matt Meyer served as Magofna’s counsel.

Detective Norman Rasiang said the victim reported the incident to the Department of Public Safety dispatcher on July 15 at about 2:26 a.m.

Police, who said the victim reeked of alcohol, found a marijuana plant outside the house.

The victim told police that after she arrived home from a Rosary prayer, Magofna became angry at her, grabbed her by the shoulder, and slammed her head down on the picnic table several times.

Magofna  admitted owning the marijuana plant, police said.
