During yesterday’s bail hearing, Judge David A. Wiseman ordered Randy R. Dela Cruz to post 10 percent or $1,500 of the recommended cash bail for his release.
Wiseman set the preliminary hearing for July 7 at 9 a.m. The arraignment will be held on July 14.
Wiseman also ordered Dela Cruz to return to the court whenever required to do so, surrender all his travel documents, not leave Saipan, stay away from seaports and airports, and have no direct or indirect contact with the complainant and her minor children.
In an affidavit, Detective Vicente Boki Babauta said the Department of Public Safety received a report about a disturbance incident in Falugula, San Jose on June 27.
Babauta said responding police officers arrested Dela Cruz and brought him to the Department of Correction where he was booked and detained.
According to the complaint filed by a woman, she was asleep with her two daughters — four and six years old — when Dela Cruz broke their door and started shouting and screaming.
The complainant said Dela Cruz was carrying a machete and was holding it over his head while asking them if they wanted to be killed.
A witness later told police he heard somebody shouting and banging on his doorway. The witness said he recognized the voice of Dela Cruz who was asking him to come out and fight him. The witness said he did not open his door and called the police instead.
He later heard the complainant and the two children screaming.
Babauta said based on the complaints, there exist a probable cause to charge Dela Cruz with disturbing the peace, criminal mischief, and assault with a dangerous weapon.
