Presiding Judge Robert C. Naraja also gave Julian Sablan credit to one year and four months already served at the Kagman Detention Center and the Department of Corrections. Sablan must also pay approximately $4,896.19 in restitution, fines, fees and probation fees.
The defendant appeared for the sentencing hearing with counsel Joaquin DLG Torres. Chief prosecutor Kevin A. Lynch represented the government.
The defendant’s remaining jail term of 12 months shall be served in batches during weekends. The defendant’s first batch weekend jail term which began on June 5, 2009 shall cover the first three years up to the last weekend of May, 2012. The weekend jail terms shall begin at 4:30 p.m. on Friday up to 7:30 a.m. on the following Monday.
The second-batch weekend jail term shall cover the next four years which will start on the first weekend of June, 2012 and up to the last weekend of May, 2016. The weekend jail terms shall begin on Friday at 4:30 p.m. up to the following Sunday at 4:30 p.m. The defendant’s remaining 12-month weekend jail term is subject to future modification under the “Buy-Down Reduction Incentive Program” provided.
Naraja also placed the defendant under 10 years probation for the duration of his suspended sentence and comply with any directive imposed by his probation officer relevant to his supervision. The defendant must also report to the Community Guidance Center for an initial evaluation and undergo any recommended counseling as well as drug and alcohol abuse, and complete such counseling and comply with the terms of treatment. He must also obey all CNMI and Federal laws.
He must perform 400 hours community work service, write an apology letter to the victims, Roshi’s and Victory Chapel but have no further contact with them. He must also pay restitution in the separate criminal cases he was charged with—$119.50 for three DVD players, $517.19 in lost merchandise and property damage,$124.50 for damage to a window, $35 in stolen merchandise, and approximately $2,500 in stolen US currency. He must also pay a fine of $500, an assessment fee of $100 and $1,000 probation fee payable every year at the rate of $100.
Under the “Buy-Down Reduction Incentive Program”, the defendant is entitled to a reduction in jail term and probationary period if he completes any of the following: reduction of 30 days jail term and one year probation for an award of a High School diploma or its equivalent, example GED, Adult Education.
If the defendant gets accepted to an off-island JobCore Program in Hawaii or Idaho, he will be entitled to a suspension of his sentence upon his departure, and completing the program will entitle him to a total sentence reduction.
