Juan Diego Matagolai had already served 13 days at the Department of Corrections facility after his arrest.
For the remaining 17 days of the sentence, Superior Court Presiding Judge Robert C. Naraja ordered Matagolai to serve his jail time during weekends “to allow [him to] maintain gainful employment” and meet his monetary obligations.
On Jan. 22, 2009, Matagolai handed “ice” to an undercover officer and a cooperating source of the Department of Public Safety’s Narcotics Unit.
Matagolai has a co-defendant, Marwin Borja Camacho, 29.
The Attorney General’s Office filed one count of trafficking of controlled substance, and one count of illegal possession of controlled substance against Matagolai and Camacho.
Matagolai signed a plea agreement admitting to illegal possession of a controlled substance.
Matagolai’s counsel was F. Matthew Smith while Assistant Attorney General Shelli Neal represented the government.
As part of the plea agreement, Matagolai will cooperate fully with the Department of Public Safety or the AGO .
Naraja placed Matagolai on five years of supervised release under the direction and supervision of the Adult Probation Office.
The court required Matagolai to pay a $2,000 fine to be paid prior to expiration of his probation; a $100 court assessment fee to be paid within 60 days; and a $500 probation fee.
Matagolai will complete substance abuse counseling at the Community Guidance Center, as well as subject himself to random drug testing by the Adult Probation Office.
Matagolai’s failure to seek and maintain gainful employment during the entirety of his probation term will violate the court’s order, Naraja said.
Matagolai will not associate with any known user or trafficker of controlled substance, and must obey all CNMI and federal laws as well as the rules of the Adult Probation Office.
