Luis P. Cruz appeared in Tinian Superior Court for a change of plea hearing on Feb. 13.
He pleaded guilty to one count of aggravated assault and battery and the court agreed to dismiss all the other charges.
The defendant was represented by his counsel Joey San Nicolas while the government was represented by Chief Prosecutor Kevin A. Lynch.
Wiseman placed the defendant on supervised probation for five years.
Cruz will pay restitution in the amount of $10,000 to the victim, half of which should be paid on the date of his plea.
The $5,000 bail he posted on April 29, 2008 is forfeited and paid toward the first payment.
The remaining balance of $5,000 will be paid in monthly installments for six months, or $833.33 each month.
Failure to pay an installment is a violation of probation and will subject Cruz to revocation proceedings.
He will pay a fine of $300, an assessment fee of $25 and probation fees to be assessed by the Office of Adult Probation.
The defendant must write a letter of apology to the victim, Jingzhu Cui, within 30 days and must have no contact with Cui during his probationary period.
Cruz will report to the Community Guidance Center for initial evaluation and undergo anger management counseling, substance abuse, and medication if prescribed.
He must not possess or consume alcohol during his probationary period and must seek or maintain full time employment.
He is not allowed to leave the CNMI without permission from the Probation Office.
Wiseman set the review hearing for June 12 at 9 a.m. in the Tinian Superior Court.
The assault incident happened at the Huang Shun U-Save Supermarket at 12:46 a.m. on April 13, 2008.
A companion of the victim told police that he and the victim had a drink at U-Joy Nite Club that night.
When they went out, the victim got into an argument with Cruz who struck Cui with a motorcycle helmet and spat on him when he was already lying on the ground.
