Alam Bhuiyan has been ordered to post $1,000 bail for his temporary liberty.
Associate Judge David A. Wiseman allowed the defendant to post 10 percent or $100 of the bail in cash and the remaining $900 in unsecured bond.
Bhuiyan appeared in court for a bail hearing yesterday represented by Assistant Public Defender Matthew Holley. Assistant Attorney General George Hasselback appeared on behalf of the government.
Wiseman set a preliminary hearing for July 20 and the arraignment for July 27.
Detective Christopher Leon Guerrero stated in his affidavit that at 4:14 p.m. on April 29, 2009, a man reported a theft of vehicle incident at the Department of Public Safety.
Bhuiyan sold the 2005 silver Toyota Corolla four-door sedan which he borrowed from Mohammed J. Miah.
Miah learned his vehicle was sold to Awlad Hossain for $5,200.
Miah said when Hossain was informed that the sale was illegal, he surrendered the vehicle to DPS where it was temporarily secured.
Police said Bhuiyan admitted selling the vehicle to Hossain on April 22, 2009 for $5,200.
He also sold the same vehicle to Miah on May 27, 2008.
Police said it was clear Bhuiyan deceived Hossain by selling the same car owned by Miah.
Hossain told police that he already spent $700 for the replacement of the front windshield after he bought the car from the defendant.
The car was given back to Miah even as the defendant eluded Hossain who was trying to get his money back.
Police learned from Hossain that the defendant had been attempting to leave Saipan.
Bhuiyan told the court yesterday that he had been on Saipan for 12 years.
