On Tuesday, Wiseman approved Germinaro’s release on recognizance and told the defendant that he will be placed under home confinement electronic monitoring under the direction of the U.S. Probation Office.
Germinaro was represented by attorney Colin Thompson, while Assistant U.S. Attorney James Benedetto prosecuted the case.
Federal Probation Officer Margarita Wonenberg was also present during Germinaro’s change of plea hearing.
In the amended plea agreement, Germinaro pleaded guilty to two counts of possession of a controlled substance with intent to distribute.
Germinaro is facing a maximum penalty of not more than 20 years imprisonment, a fine not more than $1 million, a $100 special assessment fee, and a minimum term of supervised release of three years.
The plea agreement stated that Germinaro possessed with intent to distribute “ice” on Aug. 12 and 26, 2008.
Drug Enforcement Administration special agent Daniel G. Holcomb stated in his affidavit that between Aug. 2008 and July 2009, Germinaro, Julita A. Sablan, and Roque Norita “knowingly and willfully conspired and agreed together” to possess and distribute “ice.”
Germinaro, Sablan, and Norita were arrested last September.
Sablan and Norita earlier pleaded not guilty to “ice” trafficking.
