Man who died after being hit by 2 cars was to be deported

Rodriguez Suka, 42, was a citizen of Chuuk, the Federated States of Micronesia, and was convicted of five misdemeanors in separate criminal cases.

Associate Judge David A. Wiseman issued a deportation order against Suka on Oct. 31, 2008 after finding clear and convincing evidence that Suka, was a deportable alien.

Suka appeared for a hearing on Oct. 24, 2008 as to why he should not be deported from the CNMI.

After the hearing, Wiseman ordered that Suka be removed from the CNMI according to law and regulations.

The judge also denied the earlier motion to stay deportation proceedings on Oct. 22, 2008.

On March 14, 2008, Govendo sentenced Suka to one year, all suspended except for 74 days, for pleading guilty to violating an order of protection, an six months, all suspended except for 74 days for disturbing the peace. Both sentences ran concurrently.

Govendo placed Suka on 12 months probation plus other court conditions.

He set the review hearing for Suka on Jan. 9, 2009.

Documents showed that on Sept. 30, 1998, Suka was sentenced by then-Presiding Judge Edward Manibusan to one year and six months imprisonment, all suspended after he pleaded guilty to the offense of assault and battery, and disturbing the peace.

He was ordered to perform 100 hours of community work service and was subjected to several court conditions.

Suka was successively hit by a Lexus and a Toyota Echo along Beach Road in Susupe on the evening of Jan. 20. He was pronounced dead upon arrival at the Commonwealth Health Center at 10:26 p.m.

This case is still under investigation.
