Prescott J. Cabrera pleaded guilty to assault and battery that involved domestic violence, and disturbing the peace of his wife.
Judge Kenneth L. Govendo imposed a one-year jail term on Cabrera, all suspended, except for seven days with credit for time served at the Department of Corrections facility.
Govendo warned Cabrera that if he commits another crime of domestic violence, the remaining months of his suspended sentence will be re-imposed.
The wife complained that Cabrera punched her twice on Dec. 4, 2010.
The court granted the prosecution’s motion to dismiss the remaining charge of criminal mischief.
Cabrera was ordered to pay $442 in restitution; a $100 fine before the end of his probation; a $25 court assessment fee; and a probation fee to be determined by Adult Probation Office.
Cabrera will not have any contact with his wife.
He will write a letter of apology to his wife, and his wife’s sister, to be delivered through the Adult Probation Office within 30 days of sentencing.
He will complete 100 hours of community work service, and undergo counseling at the Community Guidance Center.
