Tiberke, who is out on bail, did not want to proceed with a change of plea.
He was charged with assault with a dangerous weapon, assault and battery, disturbing the peace, and resisting arrest.
He signed a plea agreement on Oct. 18, 2011, admitting the charge of assault and battery, and resisting arrest.
The plea agreement stated that Tiberke would serve a one-year jail term for assault and battery, and another year for resisting arrest that would run consecutively, but all suspended, except for six months.
On Oct. 19, 2011, however, the court was told Tiberke did not wish to change his plea.
Assistant Attorney General Russel Lorfing is prosecuting the case, while Assistant Public Defender Matthew Meyer represents Tiberke.
On June 8, 2011, responding police officers saw Tiberke chasing his victim.
When asked by police, the victim said Tiberke threatened to kill her with a machete.
Tiberke shouted at police officers not to enter his property.
Police pepper sprayed Tiberke to neutralize the defendant who resisted arrest.
Prior to the incident, Tiberke, his partner, and her infant son were supposed to go to her mother’s house in Kagman.
Tiberke said he had to go somewhere with his boys so the victim decided to go with her sister.
An argument ensued, during which Tiberke puller her hair, and slapped her in the face, police said.
The victim tried to call her family member to pick her up, but Tiberke grabbed a machete from their car, and told the victim to get inside, police said.
Tiberke told his victim, who was then carrying her son, that the only way her son would leave the area would be in a casket, police added.
