Man with multiple cases released after promising to appear in court

Inos also ordered Eria B. Elliot to obey commonwealth laws and keep all appointments with his lawyer. The court issued a bench warrant against the defendant for failing to show up for a scheduled hearing.

The government was represented by Assistant Attorney General Edward Buckingham.

 Inos set the review hearing for Feb. 21  at 1:30 p.m.

On Aug. 28, 2008, the  Attorney General’s Office through Chief Prosecutor Kevin A. Lynch filed an information against Elliot charging him with one count of assault and battery and one count for disturbing the peace.

The information stated that the defendant punched Joselito Rivera in the face on July 2, 2008. The defendant was also accused of annoying Li Zhiyuan on the same day.

The defendant is likewise facing two separate counts for disturbing the peace.

Detective Andrea C. Ozawa stated in her affidavit that on Aug. 21, 2006 at about 1:02 p.m., the Department of Public Safety received a call reporting a disturbance at the Garapan  Market and Laundry.

Responding police officers learned that the report was the second incident at the same location involving the same suspect, which police later identified as the defendant.

Investigation showed that the defendant, who was apparently under the influence of liquor, had been harassing customers at the Garapan Market and Laundry.

When confronted, the defendant told police officers that he was having a problem — that he was hearing things and he wanted to punch somebody.

The victim who called DPS for assistance told police that in the first incident, she was folding clothes when the defendant grabbed them and threw them to the floor.

The victim said the defendant kept shouting at the customers of the laundromat.

According to the victim, the defendant was involved in a prior case when he broke the window of a car.

The defendant is also facing charges for one count of burglary for entering an occupied structure with the purpose of committing theft on Dec. 28, 2004, and one count of theft for taking a television and stereo system of Brad Elliot.
