Fritz Pacific was a subcontractor hired by IPI to provide manpower staffing services for the ongoing hotel-casino construction project in Garapan.
IPI and Fritz Pacific entered into two successive contracts beginning around June or August 2018.
As part of their agreement, Fritz Pacific was to provide IPI with skilled plumbers, carpenters, masons, electricians, welders, skilled helpers, tower crane operators, HE Mechanics mechanic helpers, equipment electronics technicians, tractor trailer operators, Boom Truck operators, riggers, and two laborers.
All have met the demand and desired quality workmanship, performed within a reasonable time frame expected by IPI, the complaint stated.
It added that staffing hours, statement of accounts, billing, invoices, and payroll records from Fritz Pacific were confirmed with IPI-executed timesheets.
However, IPI only made partial payments on the billings and invoices provided by Fritz Pacific, the complaint stated.
Around November 2019, IPI created a new company, AM Group, to take over as manpower staffing company, effectively terminating Fritz Pacific staffing services.
Fritz Pacific is suing IPI for $745,303.94 for nonpayment of the balance amount for manpower staffing services, plus interest, fees, and costs.
Despite endeavors in good faith on the part of Fritz Pacific to resolve the dispute prior to filing this case, IPI refused to honor its obligation to Fritz Pacific, the complaint stated.
