Superior Court Presiding Judge Robert Naraja ordered Martin to pay a $300 fine, a $25 court assessment fee, a $300 probation fee, and restitution for his victim.
Martin will also write a letter of apology, and stay away from his victim and the victim’s family.
He is expected to be released from prison on April 21, 2012 and will be placed on three years probation.
Martin was also charged with forgery.
Moreover, the prosecution said, Martin left a minor child unattended in a car while he conducted a business transaction in a horse racing establishment on April 7, 2011, the same day the victim reported a burglary and theft incident at the victim’s residence in San Antonio.
On April 8, police received a call from the victim who was at New World Market, where Martin was captured on a surveillance video receiving cash change after purchasing items with a stolen check.
Assistant Attorneys General Eileen Escudero Wisor and Benjamin Petersburg prosecuted the case, while Martin was represented by Chief Public Defender Adam Hardwicke.
