The complainant is Bo-Wha Lee, who is represented by attorney William M. Fitzgerald. The defendant is Sun Hee Ahn.
Lee is asking the Superior Court to order the defendant to pay compensatory damages that will be proven at trial and other relief that the court deems proper.
According to the complaint, the son of the plaintiff was walking in the vicinity of Mount Carmel School in Susupe at about 3 p.m. on Feb. 11, 2008 when the defendant, who was operating a motor vehicle at an “excessive rate of speed” for a school zone, hit the minor.
Fitzgerald said that it was the duty of the defendant to operate her vehicle with reasonable care and with regard to others who are using the road.
Fitzgerald said because of the “negligent, reckless and careless” way the defendant drove her vehicle, the victim was knocked to the group and was severely injured.”
The plaintiff said the defendant failed to keep a proper lookout and maintain her vehicle under proper control, failed to apply her brakes in a timely manner and did not signal or blow her horn to avoid striking the victim.
According to the plaintiff, the defendant failed to yield to the right of way and drove directly into the victim.
As a result, the complaint stated, the victim broke his heel and had to undergo two operations.
The accident caused the plaintiff economic losses as he had to pay for medical and other costs related to his son’s treatment, his complaint stated.
The court ordered the defendant to answer the complaint within 20 days
