Naraja cancels review hearing for deported woman

Presiding Judge Robert C. Naraja issued the order after being informed that Xia Tang, 41, also known as Mimi, had been removed from the CNMI on July 7, 2011.

Tang’s application for a new passport was earlier denied by the Chinese government after she was convicted in an “ice” case.

The review hearing before Naraja was regarding Tang’s conviction on obstruction of justice.

Tang was sentenced to one year all suspended, and credited for the two hours she was detained at the Department of Corrections facility.

According to the Attorney General’s Office, Tang “unlawfully resist[ed] or interfere[d] with a law enforcement officer in the lawful pursuit of [his] duties” on March 21, 2010.

In the “ice” case, Tang pleaded guilty to the offense of illegal possession of controlled substance on Feb. 20, 2008.

The Superior Court said the Office of the Adult Probation will continue monitoring Tang during her period of probation, set to expire in 2013.

Tang was sentenced to five years of imprisonment, all suspended, except five months with credit for time served since Oct. 2007.

Part of the plea agreement is Tang’s voluntary departure at her own expense.

After two years and 13 court review hearings to monitor her compliance regarding her removal, the court was told of Tang’s predicament in securing her return to China.

The court noted that at the beginning of the “ice” case, Tang surrendered her expired passport after her arrest in Oct. 2007.

After serving her prison term, Tang attempted to renew her passport.

During the first year and a half, Tang was unable to raise money for the passport fee. The commonwealth helped her pay for it.

The court was told that four months after remitting the passport fee, Tang was advised that it would not be renewed because of her criminal conviction.

Her check payment was returned.

Tang’s subsistence came from her friends who voluntarily supported her.
