Bruce Jorgensen, the lawyer for anonymous retirees Jane Roe and John Doe, is asking the U.S. District Court for the NMI to “strike for disgorgement and other relief” the motion of attorney Braddock Huesman, who is representing Fund board of trustees Pedro Q. dela Cruz, Sixto K. Igisomar, and Adelina C. Roberto.
“Just as person seeking equity must themselves do equity, Mr. Huesman should be compelled to follow the court’s local rules as a prelude to initiating, interposing, and perpetuating satellite litigation predicated overwhelmingly if not entirely upon improper motive/purpose and prior conduct of questionable if not lawfully/equitably impermissible nature,” Jorgensen stated in his latest motion.
In his July 28 response to the plaintiffs’ opposition to the motion for sanctions, Huesman said the Fund and its board of trustees filed their motion in an attempt to establish a “floor” in this litigation.
Huesman said Jorgensen made false allegations, relied solely on ad hominem attacks, failed to discuss the appeal in this matter, and failed to discuss the adverse law in this matter.
Huesman said the federal court “now has a choice whether to allow this type of pleading or not.”
He added, “The board submits that a paper that rests on insults, attacks and lacks any case law to support it can only be frivolous and for an improper purpose.”
Huesman is asking the court to strike Jorgensen’s offending motion, order Jorgensen to file an apology with this court admitting the allegations were false, fine the lawyer in an amount sufficient to deter him from filing similar papers, and administer any nonmonetary sanction the court sees fit.
