Herman’s Bakery management earlier told Compliance Safety and Health Officer Diantha Goo that the U.S. Department of Labor should get a court order before it could conduct its inspection.
Goo tried to inspect Herman’s Bakery on July 29, 2011.
In her declaration in support of application for inspection warrant, Goo told the federal court that Herman’s Bakery was selected by OSHA “on an impartial basis for a programmed general schedule under the Amputation National Emphasis Program.”
Goo met with and explained to Herman’s Bakery assistant general manager Annie G. Hayes the purpose of the OSHA inspection.
After waiting for over 45 minutes, Hayes relayed to Goo that her general manager, Juan. T. Guerrero, also the Herman’s Bakery president, said that “if OSHA wanted to conduct an inspection, OSHA should get a ‘court order.’”
On Aug. 3, Chief Judge Ramona Villagomez Manglona granted OSHA’s request for an inspection warrant of Herman’s Bakery.
Goo filed a return and notice of inspection in federal court the next day.
