Overstaying garment worker ordered to post $1,000 bail

Associate David A. Wiseman also ordered Cunfu Zhang, a resident of San Antonio to report to the court for all scheduled hearings, obey all commonwealth laws and not leave Saipan without permission from the court.

Wiseman set an order to show cause hearing for the defendant for Dec. 18, 2008 at 2 p.m.

In his affidavit, Department of Labor and Immigration investigator Edward Sablan stated that the 36-year-old defendant, a citizen of the People’s Republic of China, was issued a work permit as sewing machine operator for Mirage Saipan Co., Ltd. garment factory on Oct. 30, 1999. His work permit expired on June 25, 2000.

Sablan said after the expiration of the defendant’s permit, there was no renewal, no extension, no pending labor complaint or any authorization for him to remain in the CNMI.

Sablan added that on Nov. 21, 2001, he assisted an investigation conducted by the Department of Public Safety.

He said he interviewed the defendant who told him that his name was Hel Le, born on April 1, 1970 but he did not have any proof of identification at that time.

 Sablan said he scheduled the defendant to come to the Immigration office for further interview and to show his entry and work permit but the defendant did not show up for the interview.

Sablan said the defendant was avoiding detection and arrest.
