Parole board denies application of man who fatally shot cousin

Chief Parole officer Joseph T. Guerrero also announced the following:

• Elaine Quitugua Terlaje’s application remains under review and a decision will be announced once a review has been completed.

• James Michael Fitzgerald, parole granted

• Ignacio M. Leon Guerrero, parole revoked.

Variety was told the parole board took into consideration the seriousness of Oscar Reyes Babauta’s crime and the safety of the community in denying his parole application.

Babauta is serving 35 years, with eight years suspended, for fatally shooting Jose Boki Babauta in 1997.

Terlaje, a former Commonwealth Utilities Corp. credit and collection supervisor, was sentenced to three years in prison. The prosecution said she was involved in a conspiracy to reconnect disconnected accounts or not disconnecting delinquent accounts in exchange for cash. She was also ordered to pay $50,000 in restitution.

Fitzgerald, former Commonwealth Telecommunications Commission chairman, was sentenced to five years in prison for theft of $88,202.92 in public funds.

Leon Guerrero was sentenced to two years imprisonment for burglary, and two years for forgery of checks in the total amount of $3,000. The sentences run concurrently.

“Mr. Guerrero was also convicted for possession of controlled substance (meth),” Parole Officer Guerrero said.

“Once your parole is revoked you must serve the remaining term of your original sentence plus the sentence for the additional conviction.  His recent charges while on parole were for armed robbery…of Winchell’s in Susupe,” the parole officer added.

The jail sentence that Ignacio Leon Guerrero has to serve was not immediately known.
