Board of Parole chief Joseph Guerrero said Dela Cruz, 24, was released on parole status after his initial preliminary hearing on Nov. 10, 2010.
“He will have to comply with additional parole conditions as imposed by the hearing examiner,” Guerrero told the Variety.
“The hearing examiner rendered a decision to reinstate [Dela Cruz] back on parole with stringent additional parole conditions for compliance,” Guerrero said.
After the Superior Court ordered Dela Cruz’s release on Oct. 26, the Board of Parole issued a warrant for his arrest for parole violation.
But as moved by the Attorney General’s Office, the rape charge against him was dismissed by the trial court two days later.
An 18-year-old girl earlier claimed Dela Cruz raped her, but later told police she fabricated her statement “because she wanted Dela Cruz to go to jail so that he would stop bothering her.”
Dela Cruz was arrested on Oct. 20, 2010 after the victim filed the complain.
Court records showed that Dela Cruz was granted parole on Sept. 16, 2009.
Dela Cruz was sentenced to six years imprisonment, all suspended except for four years, after he pleaded guilty to the sexual abuse of a minor in the second degree on Feb. 20, 2008.
