Visiting Guam Judge Joaquin V.E. Manibusan Jr. also directed both parties to submit a “confidential settlement letter, no more than 10 pages in length,” by 3 p.m. on Nov. 17, 2010.
Manibusan said: “The letter should set forth the party’s statement of the case, including the strength and weaknesses, and the party’s settlement position, including the last offer or demand made by the party and a statement of the offer or demand the party is prepared to make at the settlement.”
The settlement conference letter will be returned to the party that submitted it at the end of the settlement conference, Manibusan said.
NMC is asking $50,000 in damages against Fernandez, according to attorney Michael Dotts.
He said his clients “will likely present an expert on proper procedures for grade changes and also with regard to rules and procedure applicable to the college and also possibly on the duties of a college president.”
Based on preliminary computations, Fernandez is asking “almost $300,000 based on the termination of her employment contract,” according to her attorney Brien Sers Nicholas.
The initial computation does not include attorney’s fees and costs, as well as punitive damages, Sers Nicolas said.
The NMC regents fired Fernandez in April 2010.
