THE police seized last week the money in the banks belonging to Plumeria Resort to satisfy a $165,000 judgment issued by the Guam Superior Court over a civil lawsuit.
The police served a writ of execution to the banks in the CNMI and to the Department of Finance, which held the money or personal property of Micronesia Systems, Inc., owner of Plumeria Resort, and Saipan Achagao Joint Resort Association and Micronesia Co. Ltd.
CNMI Superior Court Associate Judge Virginia Sablan-Onerheim issued the writ of execution directing the Department of Public Safety to collect $165,337 due on a court judgment.
The judge directed DPS to get the defendants’ funds from any banks in the CNMI and any tax rebate check due from the Department of Finance.
DPS was directed to release the personal property, funds or checks to the O’Connor law firm, counsel for the plaintiff, AM Insurance, Inc.
It was not clear how much was obtained pursuant to the court order.
According to AM Insurance attorney Gregory J. Koebel, the Superior Court of Guam issued a judgment on Oct. 30, 2000 against the defendants pertaining to the plaintiff’s lawsuit over debt.
Koebel said that in May 2001, a stipulated judgment was issued by the Superior Court of Guam against defendants ordering them to pay the principal amount of $135,494 plus interest, attorney’s fees, and additional costs.
Court documents showed that Toshiyuki Kobayashi, president and representative of Micronesia Co. Ltd., signed the stipulation.
