Ports police staffer allowed to post 10 percent of bail

Judge David A. Wiseman remanded Borja to the custody of the Department of Corrections after he failed to post bail on Friday.

Borja is being held on charges of assault and battery, disturbing the peace, and criminal mischief.

Detective Peter Aldan said the incident occurred on Sept. 21, 2011, between 8 and 10 p.m., at the Duenas residence on Navy Hill.

Police said Borja had been drinking beer at approximately 8 a.m. that day, and slept with the victim at about 6:30 p.m.

Later, Borja’s phone rang; his mother calling. But the victim said Borja was sleeping and didn’t want to wake up.

Two more calls came in, but no one answered so the victim hung up.

She later recognized the number to be that of Borja’s former girlfriend.

The former girlfriend answered when the victim called.

The former girlfriend said she was trying to call her brother but accidentally dialed Borja’s phone number twice.

The victim had a feeling that something was going on as she found the former girlfriend’s number on Borja’s phone.

The victim  then woke up Borja. She told the defendant his mother called as well as his former girlfriend. She also said she wanted him to leave her house.

The victim gathered Borja’s clothes and put them in a bag, took his car key and handed it to the defendant.

Borja choked his victim, saying he was not cheating on her, police said.

The victim called 911 after Borja released her.

The victim went upstairs into her daughters’ bedroom, but Borja banged hard on the door causing the victim’s two daughters to cry.

When the victim opened the door,  Borja grabbed a folding beach chair inside the bedroom and swung it at her, but missed, police said.

The bedroom window was damaged.

Borja was about to leave the victim’s residence, but alighted from his vehicle, and punched the victim in the middle part of her back “real hard without saying a word,” police said.

When the victim saw the responding officers she shouted for help as Borja walked back into the garage where he was arrested.
