Associate Judge Kenneth L. Govendo granted the request of the government to revoke the probation of 36-year-old Norman Evangelista Omar that was to expire on Sept. 7, 2008.
The court set a review hearing on Aug. 7, 2008 but the defendant failed to appear.
Omar was convicted on Sept. 6, 2007 of assault and battery and resisting arrest. He was ordered to keep all appointments with the probation officer, pay a $100 probation fee, a $25 court assessment fee, $200 in fines and to serve 100 hours community work service.
Omar was supposed to pay his probation fee of $33.33 starting at the end of June 2008 but he failed to do so. He likewise failed to pay the court fee and the fine at a rate of $66.66 per month, and did not report to the Office of Adult Probation on June 16, 2008 to perform his community work service and counseling referral as directed.
Omar was charged with two counts of assault and battery, one count of resisting arrest and one count of disturbing the peace on Nov. 30, 2006.
He entered into a plea agreement and was sentenced to one year imprisonment for each of the three counts, all suspended except for 45 days to run concurrently. He was also placed on probation for one year.
Omar was arrested on Nov. 18, 2006 at the now defunct Nagoya Star night club in Garapan after he tried to strangle another man.
When the responding police ordered Omar stop, the defendant turned to him and pushed him on the face.
The officer struggled with the defendant who kept on resisting and shouting profane words at him.
The officer sustained red marks and scratches on his chin and neck.
