TYRON Farley Reyes Fitial, a tier 3 registered sex offender, was arrested recently after being accused of sexually molesting a minor.

Fitial, 38, was charged with sexual abuse of a minor in the third degree in Superior Court.

On Thursday, the defendant appeared before Associate Judge Wesley Bogdan, who imposed a $50,000 cash bail on Fitial.

The defendant was represented by Assistant Public Defender Emily Thomsen, while Chief Prosecutor Chester Hinds appeared for the government.

Fitial was remanded to the custody of the Department of Corrections after the hearing.

According to the complaint against Fitial, he sexually touched a minor in the home of his girlfriend.

The minor told forensic investigators that in the early morning of Oct. 7, while she was sleeping in the living room, she woke up to find that Fitial was touching her inappropriately.

She said Fitial told her she “had a nice body,” and not to tell her sister because “she will get mad at you for letting me touch you.”

She said she was scared and stayed up to wait for her older sister to get ready for work.

In the morning, the minor said her sister and Fitial dropped her at her uncle’s house. She said she told her juvenile nephew about the incident. He then told his grandfather, who called for police assistance.

In 2012, Fitial was sentenced by the federal court to serve 15 years imprisonment for enticing a 12-year-old girl detained at the Kagman Juvenile Detention and Correctional Facility to meet with him and engage in a sexual act.

At the time, Fitial was a jail guard at the juvenile detention facility.

In 2013, the Superior Court sentenced Fitial to 15 years imprisonment for the same case. The local court sentence ran concurrently with the federal sentence.
