Seung Ho Shin filed the complaint against Kim Eun Hee and Woo Jung Corp., which is doing business as Sang Jee Rent A Car.
The plaintiff, through attorney Joaquin DLG. Torres, is asking the Superior Court to award him $58,375 for unpaid wages and overtime wages, $50,000 for wrongful termination, prejudgment and post-judgment interest of 12 percent per annum, for incidental and consequential damages to be proven at trial, for attorney’s fees and costs of suit, and for other relief the court deems just.
The plaintiff stated that on Oct. 21, 2007, he got married to defendant Kim Eun Hee and the couple moved to Saipan to establish the Sang Jee Rent A Car on May 1, 2008.
The plaintiff said he invested a total amount of $100,000 while Kim Eun Hee invested $200,000.
He added that he managed the business from May 1, 2008 to Nov. 10, 2008 and worked on a 24-hour schedule without availing of a single day vacation.
He said he was surprised to receive a note of dismissal from Woo Yung Corp. on Nov. 11, 2008 relieving him as one of the directors of the company.
The plaintiff said he invested in Sang Jee Rent-a-Car business as vice president while Kim Eun Hee served as president.
He said that he worked without compensation for six months.
His termination, he added, is without basis since there was no established articles of incorporation that showed that the defendant can have the authority to remove the plaintiff as director of the corporation.
He said the articles of incorporation of Woo Jung Corp. established on May 20, 1992 do not reflect the name of the defendant as one of the incorporators or shareholder.
There has never been an amended articles of incorporation reflecting the defendant’s name as one of the shareholders or incorporators of the corporation, the plaintiff added.
The plaintiff said he worked beyond 40 hours per week and over 30 hours overtime in one week for six months.
He said he is entitled to $25 an hour for the services he performed in managing Sang Jee Rent A Car, and $37.50 an hour for every hour he worked beyond 30 hours on any given work week.
