SENATOR Celina R. Babauta said retired CNMI Chief Justice Jose S. Dela Cruz should be part of the Commonwealth’s 902 talks with the federal government.
In her “unsolicited letter” to Gov. Arnold I. Palacios on Tuesday, Babauta strongly recommended the inclusion of Dela Cruz on the CNMI team as lead counsel “should you pursue the consultative discussions with representatives of the U.S. president pursuant to Article IX, Section 902 of the Covenant.”
Babauta said she also recognizes the governor’s prerogative to select his representatives, which is why her letter is merely conveying her recommendation.
She said in the 902 talks, the CNMI needs to focus on key issues affecting the Commonwealth “now and in the near future.” These would require either U.S. congressional action, federal agency regulatory action, amendments to existing laws and regulations or a presidential executive order, she added.
“I can think of no one more suitable to provide you with the legal advice you may need than [former] Chief Justice … Dela Cruz,” Babauta said.
She said the 902 talks “represent a pivotal moment for the CNMI’s future, and having the best possible legal representation is crucial.”
According to Babauta, Dela Cruz’s “extensive experience in the CNMI legal system, coupled with his deep understanding of the Covenant relationship between the CNMI and the U.S., positions him uniquely to contribute to the negotiations.”
Babauta added, “I have reached out to Chief Justice Dela Cruz, and he is standing by for your call.”
Babauta said in addition to his qualifications, Dela Cruz’s “deep passion for the CNMI and its future is evident in his writings and public pronouncements. He is a dedicated advocate for the CNMI’s self-determination and economic development, and his participation in the 902 negotiations will be driven by a genuine desire to secure the best possible outcome for the people of the Commonwealth.”
Babauta reiterated that the 902 talks “hold immense importance for the future of the CNMI. Securing a favorable outcome requires a team with exceptional legal talent, negotiation expertise, and a deep understanding of the CNMI’s unique position.”
Dela Cruz “embodies these qualities and would be a great asset to your 902 legal team,” she told the governor.
Dela Cruz served as the CNMI’s first chief justice from 1989 to 1995.
