Supreme Court issues ruling in Guerrero DUI case

The events leading up to former Sen. Juan T. Guerrero’s conviction for driving under the influence of alcohol began on the evening of March 4, 2010 when his SUV struck a sedan driven by Chester Cuento in the northbound outer lane of Chalan Pale Arnold Road in Gualo Rai.

After interviewing both Guerrero and Cuento, and observing that the former lawmaker was displaying visible signs of intoxication, the officers arrested Guerrero believing that he was driving under the influence of alcohol.

After a bench trial, the trial court convicted Guerrero of driving under the influence of alcohol.

Guerrero appealed, contending that the trial court lacked sufficient evidence to convict him.

But the Supreme Court determined that the evidence presented during Guerrero’s bench trial was sufficient to uphold his conviction for driving under the influence of alcohol.

The court’s full opinion is Commonwealth v. Guerrero, 2011 MP 13, and can be found at http://www.cnmilaw.org/supreme_11.htm.
