Teen gets 3 1/2 years for attempted murder

Superior Court Presiding Judge Judge Robert C. Naraja imposed a 12-year jail term on Maximo San Nicolas Muna, all suspended except for three and a half years.

Naraja credited the time Muna already served at the Department of Corrections facility since his arrest on Nov. 20, 2008.

“[Muna] shall serve the full three and one half years without parole,” Naraja said.

Upon his release from prison on May 20, 2012, Muna will be placed on probation for 10 years under the direction and supervision of the Adult Probation Office.

The court required Muna to pay a $100 court assessment fee payable within 30 days upon release from prison; a $1,000 probation fee; and a $1,000 fine based on monthly schedule.

Muna will not have any direct or indirect contact with his victim Jin Bin Fan or Fan’s family.

Muna was required to pay restitution for all medical bills of the victim, the amount of which will be determined by the Adult Probation Office.

Muna will complete 1,000 hours of community service during incarceration under the Department of Corrections’ direction, and if there’s a balance upon release, he will perform it under the direction of  the Adult Probation Office, the court ordered.

Muna will obey all federal and CNMI laws as well as the rules of the Adult Probation Office.

On Nov. 17, 2008, the Attorney General’s Office stated, Muna attacked Ji Bin Fan with a knife during a robbery, and took away valuables.

Other details of the case were not available.

The AGO charged Muna with one count of attempted murder in the first degree during the perpetration of robbery, one count of aggravated assault and battery, one count of assault with a dangerous weapon, one count of robbery, and one count of theft.
