Associate Judge Perry B. Inos ordered K. San Nicolas to post 10 percent or $2,500 of the total bail in cash and the rest in unsecured bond.
The defendant appeared in court for a bail hearing on Friday, represented by Assistant Public Defender Douglas Hartig while Assistant Attorney General Mike Evangelista appeared on behalf of the government.
If the defendant posts bail, he will return to court whenever required, surrender all travel documents and will not leave Tinian without court permission. He will have no direct or indirect contact with the victim.
After the hearing, however, he was remanded to the custody of the Department of Corrections.
Inos set the preliminary hearing for March 6 and the arraignment for March 16 at 9 a.m.
According to the affidavit filed by Police Officer Barbara K. Arend, police officers found the defendant with a 13-year-old girl at the back of a parked sedan in Tachogna Beach on Tinian past midnight on Feb. 20.
Police said the victim admitted that the defendant was her boyfriend.
She said he abused him twice last year, and again on Feb. 20 in her mother’s car when they were caught by police officers.
