Through her attorney Colin Thompson, Zenaida B. Mansay, together with her two minor daughters, named defendant Vicente N. Cruz in their complaint for negligence and reckless conduct.
Thompson is asking the court to award Mansay for general, statutory, compensatory, punitive and special damages in the amount to be proven in trial; pre-judgment and post-judgment interest as allowed by law; costs and reasonable attorney fees; and other relief deemed proper by the court.
Thompson said his client Mansay, together with her two minor children, was driving her 1996 Toyota Camry in a southerly direction toward Koblerville on Oct. 25, 2009.
At about 9:30 p.m. on that day, Thompson said his client was heading up the hill adjacent south of the Pacific Islands Club playground, when a 1994 Toyota Tercel slammed head on to her vehicle.
The Tercel was owned by Carmen Santos and operated by Cruz, Thompson said.
As a result of the impact, Mansay and her two children, sustained personal injuries, Thompson said.
The Department of Public Safety investigated the incident, “and concluded that Mr. Cruz was at fault,” according to Thompson.
Cruz was charged with reckless driving, and driving under the influence.
Thompson said his clients sustained physical and emotional injuries.
Mansay and her children suffered and continue to suffer physical and mental pain and anguish, Thompson added.
Mansay also lost work as a result of her injuries, Thompson said.
