In his verdict following a bench trial at the Tinian courthouse on Friday, Wiseman said the “court having carefully considered the testimony of the witnesses, the exhibits admitted into evidence and after hearing the arguments of counsels, finds that the evidence presented proof of guilt beyond a reasonable doubt” for three counts of sexual abuse of minor in the third degree against Diaz, a Tinian Junior High School teacher.
Diaz, who has been out on bail, will be sentenced on Nov. 10, 2011 at the Tinian courthouse.
Assistant Attorney General Russel Lorfing prosecuted the case, while Diaz was represented by attorneys Edward Arriola and Joseph N. Camacho.
Diaz was arrested by authorities in Oct. 2010 for impregnating his then-16-year-old student.
The victim first met Diaz at the house of another student in Marpo Heights, “where they hung out together,” police said.
The following month, Diaz brought the victim to his house and introduced her to his parents as his girlfriend.
Diaz gave the victim an early pregnancy test kit after he was told by the student that she might be pregnant.
The victim’s mother told the Division of Youth Services officer and the police that she did not consent to her daughter having a sexual relationship with Diaz.
The victim’s skipping classes was noticed last year after a teacher informed Tinian High School acting principal Julian Hofschneider who was also told about the rumor that the victim and Diaz were having a relationship.
