Trader sues business establishments

Global Traders Inc. filed the complaint against Sung In Kim and wife Suh Hye Sun-Kim, and a separate complaint for damages and returned checks against Cho Sung Chul and Canaan Inc. which is doing business as Chalan Kiya Market, Holiday Restaurant and Canaan Catering.

The plaintiff, through its counsel Eric S. Smith, stated that he sold and delivered goods, merchandise and equipment to the Kim couple upon their request with their promise to pay for the goods ordered.

The plaintiff said as of Nov. 25, 2008, the defendants agreed that they owed the plaintiff $10,548.63 and they would commence making installment payments on the outstanding balance beginning Jan. 31, 2009.

But the plaintiff said the defendants have not made any payments and refuse to make any payment.

The plaintiff is asking the court to award him the principal sum of $10,548.63, prejudgment interest at the rate of 12 percent in the amount to be determined at trial to the date of judgment and post judgment interest rate of 9 percent from the date of judgment, for costs, attorney’s fees and other relief.

The plaintiff has also filed a complaint against Cho Sung Chul and Canaan Inc.for damages and returned checks.

The plaintiff said  between June 6, 2003 and March 2007, they sold and delivered certain goods, merchandise and equipment to the defendants upon request and upon the defendant’s promise to pay the goods.

On June 6, 2003 and May 19, 2006, the plaintiff said the defendant purchased various food items from them, but the defendant failed and refused to pay $3,722.36 in balance.

The plaintiff said the defendants failed to repay the returned check charges.

The plaintiff said the defendant presented three checks to them which were returned for insufficient funds, resulting in the plaintiff incurring bank charges.
