Superior Court Judge David A. Wiseman imposed a 30-day jail sentence on Tudela, all suspended, and credited 23 days he served in Department of Corrections facility.
The court ordered Tudela not to have any contact with his brother Pedro, his immediate family, his place of employment or residence. He will not approach within 100 yards of his brother.
Tudela was placed on one year probation, and will refrain from consuming any alcoholic beverage during this period, the court ordered.
Tudela will pay a $50 fine, and a $10 court assessment fee, and a probation fee.
According to factual basis for plea, Tudela “deprived his brother…of his right to peace and quiet by threatening him and his family” on Thanksgiving.
The initial police report indicated that Tudela was in his brother’s house when a commotion broke out over a land dispute.
Tudela threatened to kill his brother and the victim’s family, police said.
There was a rifle in Tudela’s vehicle.
There was a struggle, and Tudela’s brother took possession of the rifle, but was eventually overpowered by Tudela who escaped with the rifle, police said.
