In yesterday’s bail hearing, Associate Judge David A. Wiseman imposed a $10,000 bail on Domingo Blas Cruz and $5,000 bail on Shomia Panopio Muna.
Cruz can post 10 percent or $1,000 of his bail in cash and the remaining amount in unsecured bond.
Muna can also post 10 percent or $500 of the bail in cash and the remaining amount in unsecured bond.
Wiseman set the preliminary hearing for June 29 and the arraignment for July 6.
The two defendants were charged with burglary, theft and assault and battery.
Detective Christopher Leon Guerrero stated in his affidavit that at 4:22 p.m. on Feb. 18, a woman called the Department of Public Safety and reported a burglary/theft incident on the second floor of Pastel Inn Apartment in San Jose.
Leon Guerrero said when police officers arrived at the scene, they heard a woman screaming and learned that Cruz fled toward the back of the apartment.
Police saw Cruz climbing the fence.
A black school backpack was recovered containing assorted jewelry and wristwatches which the victim positively identified as stolen from her room.
Leon Guerrero said a police officer who was near the area saw Cruz wearing a black long sleeved sweatshirt and red short pants and carrying a black backpack.
He then threw the backpack at the officer, ran toward the back of the apartment, climbed over the fence and fled the area.
The police officer identified Cruz from a photo lineup of six suspects.
The witness who called the police for assistance said she lived directly above the crime scene and was cooking when she heard noise coming from the lower room.
She learned that nobody was at home so she contacted the police.
The witness said she looked down and saw somebody’s hands at the edge of the balcony.
The husband of the witness told police he went home after getting a call from his wife and saw a blue SUV in the area.
The husband wrote down the plate number and saw a female, later identified as Muna, at the driver’s side hiding inside the vehicle.
As he was walking toward the right passenger side of the SUV, the female driver suddenly drove away but the vehicle was blocked by police officers.
Muna said she was supposed to pick up her boyfriend.
Investigation showed that $600 in cash and approximately $2,500 worth of jewelry were stolen — 15 assorted wristwatches, assorted gold necklaces, rings, earrings and a black diamond earring worth $1,000.
These were recovered but not the $600 in cash.
