THE CNMI Supreme Court has designated a Guam associate justice to preside over a motion to recuse or disqualify Associate Justice Alexandro C. Castro and Justice Pro Tem Alberto C. Lamorena III in the Bank of Saipan receivership proceedings.
Chief Justice Miguel S. Demapan appointed Guam Supreme Court Associate Justice Frances Tydingco as justice pro tem to hear the motion filed by Commerce Secretary and Banking Commissioner Fermin M. Atalig.
“It is appearing to the undersigned that the prompt and efficient dispatch of the business of the Supreme Court requires the service of a temporary justice in this matter,” said Demapan in the order.
Demapan and Associate Justice John A. Manglona had recused themselves from the bank’s receivership issues.
Atalig and Bank of Saipan receiver Randall T. Fennell moved to disqualify Castro and Lamorena from participating in the Bank of Saipan matter “on account of an appearance of impropriety, bias, and prejudice in favor of attorney David J. Lujan.”
