Victims of car collision file complaint vs driver

Based on the complaint, Agullana, on the day of the accident, was driving north in a Mazda car in Susupe near the intersection of the former Nauru Building and Saiapn World Resort at 1 p.m. on Aug. 12, 2006. Cordova was a passenger.

The defendant, who was driving a Toyota heading toward west on the Nauru Building access road did not stop at a red light and crossed the northbound lanes, and his car almost collided with another motorist, the complaint stated.

The defendant’s car crossed into the path of the plaintiff’s vehicle which swerved to the left, avoiding Huan Wang Sharer’s car but collided with Eugene Provido’s car.

Smith said that as a direct result of the defendant’s negligence and failure to follow traffic code, Agullana’s car collided with Provido’s car resulting in injuries to the plaintiffs.  

Smith said the defendant’s vehicle was operated in a dangerous manner. He said  the defendant failed to yield the right of way to a vehicle that was proceeding through the intersection and not stopping at a red light.

According to Smith, the defendant is guilty of negligence and was the cause of the collision for which he should be liable for damages.

He added that the plaintiff’s car was damaged and that the plaintiffs suffered injuries as well as sustaining physical pain and mental anguish.
