Superior Court Presiding Judge Robert C. Naraja originally sentenced Villagomez to one year imprisonment, all suspended except for 30 days for each count and to be served concurrently.
The court credited 14 days Villagomez already served at the Department of Corrections facility.
He is expected to be released from prison on Sept. 16, 2011 and will be placed on probation for one year.
Villagomez was ordered to pay a $100 fine, a $25 court assessment fee and a $100 probation fee.
He will also pay $226 as restitution for the cost of repairing the glass at the Corrections facility, and damage to police vehicle in an amount to be determined by the Adult Probation Office.
He will complete 50 hours of community work service.
While resisting arrest, the prosecution said Villagomez kicked Police Officer Arnold Sarapio on the chest, face and arms on Feb. 28, 2010.
While inside the police car, Villagomez, who was drunk at that time, kicked the vehicle’s door and glass window, police said.
After he was turned over to Corrections, Villagomez punched three times the cell’s glass window where he was incarcerated, police said.
When Corrections personnel told him to stop, Villagomez hit the intercom on the center of the glass window causing the glass to crack around the intercom, police said.
According to Detective Patrick P. Sablan, Villagomez has a history of resisting arrest and has damaged windows of police cars in the past.
