Wiseman sentences ice trafficker to 18-month jail term

Associate Judge David A. Wiseman also ordered deportation upon the completion of Huang Feichuan’s imprisonment.

He will then be released to the Division of Immigration.

If he will not be deported, he will be placed on supervised probation for five years after his imprisonment under the direction of the Office of Adult Probation.

Wiseman ordered the 34-year-old defendant to report to the Department of Corrections on Feb. 13, 2009 at 8 a.m. to start his incarceration term.

He will also pay an assessment fee of $100, and obey all CNMI and federal laws.

The defendant appeared in court represented by Assistant Public Defender Douglas Hartig. Assistant Attorney General Kathleen Busenkell appeared on behalf of the commonwealth.

The defendant entered a guilty plea to the offense of illegal possession of controlled substance on Jan. 29, 2009.

In an affidavit, Task Force Officer Norman S. Rasiang stated that members of the Drug Enforcement Administration assisted by the Criminal Investigation Division Narcotics Unit conducted a monitored control purchase of methamphetamine or ice from the defendant on April 29, 2008.

A confidential source was given $250 to buy ice from Huang in San Antonio.

The substance the source bought was tested and indicated the presence of ice.

Police conducted another buy bust operation on April 30, 2008 when a confidential source again purchased  $250 worth of ice.

On May 30, police conducted another buy-walk operation and bought $450 worth of ice in Afetnas.

On June 3, they made another purchase of ice from the defendant worth $250 of ice at Huang’s residence in San Antonio.

The Attorney General’s Office filed an information against the defendant on June 11, 2008 charging him with five counts of illegal possession of controlled substance, and four counts of trafficking of controlled substance.

The government moved for the dismissal of all the other counts in the information, which the court granted following the defendant’s change of plea.
