Associate Judge David A. Wiseman ordered the defendant, Julita E. Santos of Turnkey Housing, to post 10 percent or $100 of the bail in cash and the remaining $900 in unsecured bond.
Wiseman set the arraignment for Dec. 12, 2008 at 9 a.m.
Assistant Public Defender Matthew Holley represented the defendant for the bail hearing. Assistant Attorney General Mike Evangelista appeared on behalf of the government.
Based on the affidavit filed by Detective Melvin I. Monkeya, the Department of Public Safety received a report about a theft incident at 11 a.m. on Oct. 8, 2008.
According to the complainant, the defendant was selling a Camry for $5,000. The complainant said he asked the defendant to lower her price to $3,000 but the defendant refused and left. At about 10 a.m. that day, the complainant met Santos at her house and Santos agreed to sell the car for $3,000. The complainant said he took the car for a test drive and found that the car engine needed extra support. He said he asked Santos to give him a discount of $50. Santos agreed. They then went to the Division of Motor Vehicles on Tinian to request for a copy but they were told to return in the afternoon as the original copy was still on Saipan.
The complainant said he gave Santos $2,950 as payment. He added that Santos asked him to drop her at her house,
On Oct. 8, the complainant said Santos gave her a letter informing him that he still owed her $2,550 for the car and if he didn’t come up with the amount at 10 a.m. that day, she would take the car back.
The complainant said the defendant used her spare key and took the car away. He said Santos sold the same car she took from him to Huang Shung Corp. for $3,000.
In his affidavit, Monkeya recommended a bail of $25,000 for the charges of theft by deception.
