Bai Jin Nu, who is represented by attorney Robert J. O’Connor, also named Police Officer 2 Jason Tarkong in her complaint.
The complainant is asking the court for general and special damages in an amount to be proven at trial, prejudgment and post-judgment interest as allowed by law, for costs of suit, and other relief.
The complaint stated that Bai Jin Nu was injured as a result of the impact of the collision.
On June 19, 2010, according to the complaint, at about 3:30 p.m., Bai Jin Nu was travelling along Tun Herman Pan Road and was about to turn left at the traffic intersection heading toward San Jose.
A DPS Ford Ranger, operated by Tarkong, “suddenly and without a warning” encroached on the victim’s lane as the police officer was making a right turn that “forcefully hit” the victim’s vehicle head-on, the complaint stated.
The force of the impact severely damaged the victim’s vehicle, a Toyota RAV4.
The victim was brought to the Commonwealth Health Center for treatment, the complaint added.
“The Department of Public Safety investigated the accident and concluded that Mr. Tarkong was at fault,” the complaint said.
O’Connor said the “CNMI is responsible for the acts and omissions of DPS and Mr. Tarkong,” adding that “at all relevant times, DPS had the duty and responsibility to properly supervise Mr. Tarkong.”
O’Connor said the commonwealth was given written notice of his client’s claims on Sept. 22, 2010, and the opportunity to investigate and address the claims.
“As of filing of this complaint, the commonwealth had still not responded to the notice, allowing [Bai Jin Nu] to proceed with this action,” O’Connor said.
The defendants did not respond to the inquiries of this reporter.
