AN alien worker whose transfer to another employer was not processed on time because his prospective employer was on an official business trip was given 15 more days to work on his employment papers.
Administrative Hearing Officer Vicente C. Seman said the circumstances that led to the delay in processing Eduardo B. Rodriguez’s employment application was beyond his control.
Seman said Rodriguez and his prospective employer, CNMI Archives Director Herbert Del Rosario, “diligently exercised reasonable efforts to gather, collect and compile all the requisite documents in preparation of an alien labor permit application” to meet the 45-day transfer period.
However, Seman said the worker became ill which prevented him, for several days, from having a physical examination to meet the labor requirements.
Moreover, the worker and his employer do not have sufficient knowledge of the procedural and substantive requirements of the Division of Labor in connection with employment application, Seman said.
