HAGÅTÑA (The Guam Daily Post) — A man was accused of hitting a jogger with his car in Tamuning on the evening of Dec. 29, 2023.
Michael Leonard Davies was charged with vehicular negligence with bodily injuries as a third-degree felony and driving while impaired as a misdemeanor in connection to the accident.
According to a magistrate’s complaint, on Dec. 29, 2023, at about 10:30 p.m. an officer with the Guam Police Department saw a pedestrian lying on the bike lane of Route 14 in Tamuning near a white Toyota Yaris.
“The officer observed that the victim’s left side of his body was bleeding and that the victim was yelling in pain,” the complaint stated.
The officer then approached the vehicle and saw Davies, 29, sitting in the driver’s seat. The officer smelled alcohol coming from the vehicle, and Davies had bloodshot, watery eyes and slurred speech.
“The report indicates that the defendant admitted to consuming eight beers earlier that night and that he just came from a bar,” according to the complaint.
A witness told police that she heard a loud noise, and when she looked across the street she saw the victim on the ground. The witness added that the white Yaris “ran over this jogger,” referring to the victim.
According to the complaint, Davies was driving southbound on Route 14 and the victim was running on the bike lane when Davies allegedly switched lanes and collided with the victim.
Davies told police he did not see the victim when he was switching lanes, the complaint stated.
Davies also submitted to a sobriety test but failed as he required assistance to keep himself up. A Breathalyzer test was also conducted, but Davies did not provide a sufficient sample.
