Man accused of sexual assault

A TINIAN resident has accused a 58-year-old man of sexually assaulting her in her house in the afternoon of July 9, 2022.

The defendant, Abul Hossain, was arrested and charged with sexual assault in the 2nd degree, assault and battery, and disturbing the peace.

According to police, Hossain, after getting paid for cleaning the woman’s yard, asked for a glass of water.

She said when she entered the house to get water, Hossain stopped the door from closing and entered the house.

Hossain saw the woman was limping and asked her if she was okay. When she told him she had hurt her ankle a few days before, Hossain asked her why she didn’t tell him about it.

The woman said Hossain then grabbed her arm and her waist and “threw her on the couch.” She said he then started massaging her ankle despite her protestations.

She told him to stop but Hossain said, “No, stop saying…that, it’s okay.”

The woman started to cry and told him that she was uncomfortable. “I don’t want to do this,” she said, but Hossain told her to “shush and stop being shy.”

She kept telling him “No, it’s okay, I’m good, can you stop?”

She said Hossain kept saying, “No.”

According to the victim, Hossain lifted her shirt all the way to her elbow and used her shirt to hold her hands down. She said Hossain kept rubbing his hands all over her body despite telling him to stop.

“This would be better if I had oil,” she quoted Hossain as saying as he began to rub her legs and pulled her pants down to her knees.

The woman said she pleaded with Hossain, “Please don’t do this,” she told him.

She said Hossain then laid on top of her, hugged her and kept saying “It’s okay, it’s okay.”

She said Hossain also started kissing her on her cheeks, her neck, and kept trying to kiss her lips but she kept moving her face away while saying, “No! Get off me!”

Hossain said, “It’s okay, only inside, no one outside has to know.”

She said Hossain “flipped her on her stomach and began touching the rest of her body.” He eventually got off her and walked out of the front door.

As he walked out, Hossain told her, “You can take off your t-shirt now because I’m leaving and don’t shower yet, because you cannot shower after you get massage.”

The victim told police that she was fighting the whole time to get him off her and was crying and begging him to stop, but Hossain was holding her down, making it hard for her to move.

The victim also told police that the next day, July 10, Hossain came to her house knocking on the doors and windows, calling her name, saying that he brought her food.

 She said the second time Hossain came to the house she went to the corner of the room and covered herself with a blanket so he wouldn’t see her.

She said she called her brother, who then called the police to check on her.

Later when she looked out the front window, she saw baby oil on the front table. She said she had a panic attack and became even more scared.

When police arrived at her house, the officer saw there was food tied to the front handle of the door.

On Tuesday, Hossain appeared before Superior Court Associate Judge Wesley Bogdan who imposed a $50,000 cash bail on the defendant.

Hossain was represented by the Public Defender’s Office while Assistant Attorney General Carmen Borja appeared for the government.

Hossain was remanded to the custody of the Department of Corrections after the hearing and was ordered to return to court for a preliminary hearing on July 28 at 10 a.m. and for an arraignment on August 1 at 9 a.m.
