SUPERIOR Court Associate Judge Wesley Bogdan has imposed a $100,000 cash bail on Justin C. Diaz, 38, who is charged with sexual abuse of a minor in the first and second degree, and disturbing the peace.
The defendant appeared in court for a bail hearing in the custody of the Department of Corrections on Thursday afternoon. The court will appoint a defense counsel for the defendant. Assistant Attorney General Carmen Borja appeared for the government.
After the hearing, Diaz was remanded to the custody of Corrections and was ordered to return to court for a preliminary hearing on Aug. 30 at 10 a.m., and for an arraignment on Sept. 18 at 9 a.m.
According to the complaint against Diaz, a 14-year-old boy reported to the police that his girlfriend was thinking of committing suicide because the defendant sexually abused her.
The girl, who is also 14 years old, later told the Division of Youth Child protective services personnel that Diaz, on Aug. 22, at 11 p.m., came into her room while everyone was asleep and sexually assaulted her.
The minor said it was not the first time that Diaz sexually abused her, adding that she does not feel safe around him.
She said she was too scared to call the police so she reached out to her boyfriend, and told him about the incident. She said she wanted to commit suicide because of what Diaz did to her.
She was seen by a sexual assault nurse examiner at the Commonwealth Health Center and was admitted to the pediatric ward for her safety.
