Man allegedly rear-ends car while drunk, occupants sent to hospital

HAGÅTÑA (The Guam Daily Post) — A man was charged with vehicular negligence and driving while impaired after allegedly rear-ending a car in Hågatña.

About 12:14 a.m. Saturday, officers with the Guam Police Department responded to a traffic crash near the intersection of Route 1 and Route 4 in Hågatña and identified John Freeman Montgomery II as the driver of a 2007 Ford Explorer.

According to the magistrate’s complaint, Montgomery was driving behind a Toyota Corolla, which had two occupants, and failed to stop before rear-ending the Corolla.

As a result, both vehicles were towed and the two occupants of the Corolla complained of pain and were taken to the hospital.

When officers arrived at the scene, Montgomery was having difficulty standing up.

“The defendant told police that he was the operator of the Ford Explorer. Officers observed that the defendant had an odor of an intoxicating beverage emitting from his person and the defendant had exhibited bloodshot, watery eyes and slurred speech,” the complaint stated.

“The defendant admitted that he had been drinking,” the complaint added.

Montgomery agreed to take a sobriety test but stumbled and almost fell to the pavement head-first, which led the officers to end the test for Montgomery’s safety. Montgomery declined to take a breath or blood test, according to the complaint.

Montgomery was charged with two counts of vehicular negligence as third-degree felonies, and driving while impaired as a misdemeanor.
