Harley Fletcher was charged with rape, burglary, assault and battery and disturbing the peace.
He appeared for arraignment on October 30 and waived reading of the information and through his counsel Assistant Public Defender Jason Shaw entered a plea of not guilty to the charges.Assistant Attorney General Anthony DeRuiz appeared on behalf of the government.Fletcher was released from custody after posting a $5,000 surety bond.He was ordered to stay away from the victim and her family while on bail release.His status conference was set for December 5 at 9:45 am. at the Melekeok courtroom.Fletcher was accused of raping a woman that the affidavit of the Bureau of Public Safety described as the defendant’s former consensual partner.The affidavit of Officer Palmer Swei stated that on September 6 the victim called the police station and reported a male intruder in her house.Police responded to the scene and found the victim crying and trembling. She had a torn mumu dress from the upper waist all the way down and had a visible mark around her neck.The victim identified the defendant as the one who physically assaulted her and tore her dress.The defendant was found at the victim’s bed. The victim told probers that he passed on her bed after the incident.The affidavit stated that victim was in her room when defendant entered through the window and jumped on her, pinning her head to the bed by holding her hair down.The affidavit stated that defendant started choking the victim, tore her dress and forced himself upon her.The victim managed to get away from the defendant later and called police for assistance while defendant passed out on the bed.The affidavit also stated that defendant had been sending messages to the victim apologizing for what he had done.The affidavit stated that victim and defendant had a prior consensual relationship that ended in April 2008.
