Xiang Cai Dong was supposed to appear in court on Friday to face his charges attempted rape, assault and battery and trespassing but a court document stated that defendant left the country on October 6, 2008.
Associate Justice Alexandra F. Foster in an order yesterday said that the matter is closed for administrative purposes only pending further proceedings.The Associate Justice said that the case remains pending and the defendant remains subject to arrest and prosecution.The affidavit submitted to court stated that Xiang Cai Dong tried to rape a woman on July 29.The affidavit stated that defendant entered the victim’s room without permission while she was lying on her bed.The affidavit stated that defendant lied on top of the victim and attempted to kiss her.When the victim screamed, the defendant covered her mouth to muffle the sound.When the victim succeeded in getting defendant’s hand off her mouth, she screamed loudly, prompting the defendant to ran out of her room.The defendant run to his room located next door and locked the door.The defendant also tried to disconnect the phone call when victim picked up the phone to call her employer. The affidavit stated that the victim and the defendant were sharing the same phone line.
