Nickasio Kintaro was charged with one count of burglary, three counts of grand larceny, one count of malicious mischief and one count of larceny from a dwelling house.The information stated that Kintaro committed the crimes on December 22, 2007.The information stated that Kintaro entered Wilie Watanabe’s Art Shop in Iyebukel, Koror and stole a safe box, digital camera and assorted jewelry.The information added that Kintaro “ damage checks made out to and belonging to Willie Watanabe.”The information also stated that Kintaro “did unlawfully steal personal property of Willie Watanabe without his knowledge from Willie Watanabe’s Art Shop which is also where Willie Watanabe sleeps as his dwelling.”The affidavit submitted to Supreme Court stated that on December 22, 2007, Willie Watanabe reported to the police that an unknown person had entered his shop and stole a safe box containing cash and checks from his brother’s funeral approximately amounting to $3,000.The affidavit stated that the shop is also part of the Watanabe residence.The affidavit stated that Kintaro admitted of breaking into the establishment to rob the shop for Christmas money.Kintaro went to the art shop at 3 am and waited outside in the rain until people stopped doing things.He then went inside a front window facing the road, maneuvered around an aquarium and passed by two male individuals sleeping on the floor and on the table and went straight to where the safe box was and took it.Kintaro also took the digital camera and the necklace from its stand then fled.The affidavit stated that Kintaro proceeded to his house and split the money with Elias Aguon then buried the safe box under a neighbor’s betel nut tree.When Kintaro returned to the site later where he buried the safe box, it was gone already.The affidavit stated that prior to the burglary, Kintaro and Aguon were drinking earlier at their house. At 2 am, Kintaro left and returned to the house at 5 am with the stolen items.
